New Law Extends Illinois EPA's Administrative Citation Authority to Used Tires
SPRINGFIELD— Gov. Pat Quinn has signed into law Senate Bill 2103, granting extended enforcement authority to the Illinois EPA under Illinois' used tire statutes.
The bill, sponsored by Sen. Mattie Hunter (D) Chicago and Rep. Naomi D. Jakobsson (D) Champaign, now known as Public Act 96-737, amends the Illinois Environmental Protection Act to allow Illinois EPA to issue an administrative citation for a violation of any of four existing requirements regarding used tires.
The new authority will allow the Illinois EPA to issue citations of up to $1500 for each violation observed, including causing or allowing water accumulation in used or waste tires, failure by a tire retailer to collect the tire user fee from retail tire customers, failure by a tire retailer to file a quarterly tax return with the Illinois Department of Revenue (also a Class 4 Felony), and transporting used tires without a valid Illinois EPA registration and vehicle placard.
"This expanded enforcement authority will allow the Illinois EPA to more effectively and directly protect human health from the hazards posed by the mismanagement of used tires in Illinois," said Illinois EPA Director Doug Scott regarding the new law. "With the continued presence of West Nile virus and other mosquito-related diseases in Illinois, this new law gives us another tool to protect the citizens of Illinois."
An administrative citation issued by the Illinois EPA is subject to appeal before the Illinois Pollution Control Board (IPCB). The Illinois EPA has had administrative citation authority for open dumping and permitted landfill violations since 1986. However, the expanded authority for used tires represents a recognition of the threats to human health posed by mosquito-related diseases and the role that improperly-managed used tires play in that threat.
