​Housing and Support Program

Housing and support institutions offer older people (aged 65 or older) or people with disabilities (aged 22 or older) a "housing with services" option. Housing and support offers an alternative to traditional nursing home care, combining housing with personal care and support services. Residents can remain independent and participate in decisions related to personal choice, dignity, privacy, and individuality.

You are guaranteed certain rights, protections, and privileges as a resident of a housing and support institution, in accordance with state and federal law. 

If you have appointed an agent with health care power, your agent can exercise your rights in your favor.

If you have appointed an agent under a durable power of attorney for health care, your agent can exercise your rights for you.

Resident's Rights

Each resident of a housing and support institution has the right to:

  • Be free from physical, mental, emotional, and social abuse, neglect, and exploitation.

  • All housing and services for which he or she has contracted and paid.

  • Keep your records confidential and provide them only with your consent or in accordance with the law that applies.

  • Have access to your records with 48 hours notice (excluding weekends and holidays).

  • Respect your private life

  • Refusing to participate or receive any service or activity, once the potential consequences of refusal have been explained to the resident and an agreement has been negotiated between the resident, their designated representative, and the service provider, as long as refusal of others is not affected .

  • Stay in the Housing and Support Program (SLF), and waive the recommended or necessary services of SLF or available from others.

  • Order and receive services not covered by Medicaid and not provided by the service provider contracted by SLF at the resident's expense, as long as the resident does not violate the conditions specified in the resident's contract.

  • Be free from physical restraints unless required during an emergency

  • Control your time, space, and lifestyle as long as the health, safety, and well-being of others are not affected.

  • Consume alcohol and use tobacco in accordance with the standards specified in the resident's SLF contract, and statutes that apply.

  • Have visitors of their choice as long as it does not affect the health, safety, and welfare of others and the provisions of the resident's contract are maintained.

  • Have roommates by resident's choice.

  • Always be treated with courtesy, respect, and full recognition of personal dignity and individualism.

  • Make decisions (except those decisions delegated to a legal guardian) as long as the health, safety, and well-being of others are not endangered by their actions.

  • Store and prepare food in your apartment as long as it does not endanger the health, safety, and well-being of the resident and others, and the provisions of the contract are not violated.

  • Designate or accept a representative to act for you.

  • You are not required to purchase additional services that are not part of the resident's contract; and that you are not charged for additional services unless a written notice is given to the resident of the amount to
