Enrollment in the 340B Program

As a result of Public Act 097-0689 (pdf), referred to as the Save Medicaid Access and Resources Together (SMART) Act, HFS will require all 340B eligible providers as defined in Section 340B of the federal Public Health Services Act to be enrolled as a 340B provider with the US Department of Health and Human Services (DHHS).

Pharmacy Providers

Effective October 1, 2012, an HFS enrolled pharmacy that is eligible to participate in the 340B federal Drug Pricing Program as defined in Section 340B of the federal Public Health Services Act shall enroll in that program. No HFS enrolled pharmacy that is also enrolled with DHHS as a 340B provider may exclude Medicaid covered medications from their participation in the program. An HFS enrolled pharmacy that is also enrolled in the 340B federal Drug Pricing Program must charge the department no more than their actual acquisition cost for the drug product plus the department established dispensing fee of $5.50 for generic drugs and $2.40 for brand name drugs. A 340B pharmacy billing the department for blood factor may charge the department actual shipping costs in addition to their acquisition cost and dispensing fee.

Other Providers

Effective January 1, 2013, an HFS enrolled provider, with the exception of a pharmacy provider, that is eligible to participate in the 340B federal Drug Pricing Program under Section 340B of the federal Public Health Services Act shall be enrolled in that program. No HFS enrolled provider that is also enrolled with DHHS as a 340B provider may exclude Medicaid covered medications from their participation in the program. An HFS enrolled provider enrolled in the 340B federal Drug Pricing Program must charge the department no more than their actual acquisition cost for the drug product.
