    I filed a claim for Unpaid Wages, but have not heard from the Department. What should I do?

    After your claim has been filed, you will receive a notification by mail with a claim number. If you have not received a letter from IDOL, your claim is still in process.​

    What is the claims process?

    The Department contacts your employer regarding your claim. Employer is given the opportunity to pay the claim or dispute the claim.

    If the Employer pays the claim the Department will mail you the check.

    If the Employer disputes the claim you will be notified by mail. You must respond to our letter to keep your claim open.

    Once the Department receives your response both responses will be reviewed to determine if a hearing is proper.

    If you have not received a letter from IDOL your claim is still in process.​

    How Long Will It Take To Resolve My Claim?

    The time it takes to process a claim varies from case to case.

    There are a number of factors that can potentially speed up or slow down the process:

    • The facts and strength of the claim;
    • If your records are complete and you provide paystubs, payroll records, vacation policy, etc;
    • How responsive your employer is;
      • ​If your employer is cooperative and your records are complete, the process is faster.
      • If your records are incomplete or your employer is uncooperative, it may take longer.
      • Finally, the Department will keep you informed in writing if we need additional information.

    If you have not received a letter from IDOL your claim is still in process.​

    What if I have more information to provide regarding a claim?

    If you have additional information to provide you can send it to use by email, fax or regular mail. Please include your file number on all correspondence.

    What if I am still waiting for a hearing date?

    You will receive your hearing notice by postal mail 30-60 days prior to the hearing date.​

    What if I already had my hearing and have not heard from the Department?

    If you are awaiting a decision, the normal time is approximately 90 days. If you have a change in address or telephone number, e-mail it to DOL.Hearings@illinois.gov​​​​
