Fair Housing Resources for Municipalities

 

Affirmatively Furthering Fair Housing
 

The federal Fair Housing Act has two main goals:  to end discrimination in the selling, renting and financing of housing, and to promote diverse, inclusive communities.  The second goal is referred to as Affirmatively Furthering Fair Housing (AFFH), and requires municipalities that receive federal funds to take proactive steps beyond simply combating discrimination to foster more inclusive communities and increase access to community assets for all persons protected by the Fair Housing Act.  More specifically, it means taking steps to proactively address significant disparities in access to community assets, to overcome segregated living patterns and support and promote integrated communities, to end racially and ethnically concentrated areas of poverty, and to foster and maintain compliance with civil rights and fair housing laws.

On July 19, 2013, the US Department of Housing & Urban Development (HUD) issued a proposed regulation to implement the affirmatively furthering fair housing (AFFH) requirements of the Fair Housing Act.  HUD issued the final rule on July 8, 2015.  Note that many of the resources on this page are based on the proposed regulation and on the requirements of the law prior to issuance of the final rule.  For more information on AFFH obligations, see the links below:

Fair Housing Month Proclamation
 

The month of April is celebrated as National Fair Housing Month as it marks the anniversary of the United States Federal Fair Housing Act – a law whose spirit embraces equal housing not only as a national policy, but a fundamental human concept.  The State of Illinois joins many other states across the nation in celebrating National Fair Housing Month.  The Illinois Department of Human Rights (IDHR) is sponsoring an effort to promote public awareness about housing rights guaranteed under the Illinois Human Rights Act, via a proclamation by Governor Bruce Rauner declaring April as Fair Housing Month in the State of Illinois, and programs informing the public about how speaking out against discrimination can improve our quality of life in Illinois.

As part of that effort, the Illinois Department of Human Rights is asking Illinois municipalities to issue a proclamation declaring April as Fair Housing Month.  This signifies the municipalities’ intention to recommit to the core values of the federal Fair Housing Act and the Illinois Human Rights Act, which call for fairness and the right to housing choice.  Once a municipality has issued a proclamation, we ask that you notify IDHR via email and send us a copy.

For additional information, please contact us at IDHR.FairHousing@illinois.gov.  The Illinois Department of Human Rights takes and investigates charges of discrimination involving real estate transactions (rentals, sales, and other transactions) concerning both residential and commercial real property.  The Department also conducts fair housing training for home seekers, landlords, property owners, advertisers, and community organizations.  The department's IDHR Training division conducts training for government, private companies and community organizations throughout Illinois designed to increase respect among diverse cultures both in the workplace and at home.
